Your arbitration fees, and your share of arbitrator compensation, shall be governed by the JAMS Schedule of Fees and Costs, where appropriate.

The arbitration shall take place in Dallas, Texas, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement.

To the fullest extent permitted by law, you agree that any arbitration or legal proceeding shall be conducted solely on an individual basis and not as a class, consolidated, or representative action. You expressly waive any right to participate in or bring a class action, class arbitration, private attorney general action, or any other representative proceeding against PolyPipe.

You further agree that the arbitrator shall not have authority to consolidate claims or to preside over any form of a representative or class proceeding. If this waiver of class or representative actions is found unenforceable, then the entire arbitration agreement shall be null and void, and any such claims shall proceed exclusively in the state or federal courts located in Dallas, Texas, subject to the Governing Law and Jurisdiction provisions of these Terms.

Furthermore, any cause of action or claim you may have against PolyPipe must commence within one (1) year after the cause of action accrues; otherwise, such claim is permanently barred.
